Terms of sale
This agreement applies between Chili Chocolate AS (org. no. 816708052) and you as the buyer of goods in the online shop Chili Chocolate.
1. The agreement
The agreement consists of these terms of sale, the information given in the ordering process and any specially agreed terms. If there is a conflict, what has been specially agreed takes precedence. The agreement is supplemented by the relevant laws, including the Norwegian Consumer Purchases Act, the Cancellation Act and the E-Commerce Act.
2. The parties
The seller is Chili Chocolate AS, Søregata 27, 4006 Stavanger. Email: post@chilichocolate.no. Phone: 926 87 647. The buyer is the consumer who places the order.
3. Price
The stated price for the goods and services is the total price the buyer has to pay. The price includes all taxes and additional costs. Shipping costs are shown at checkout before you confirm the purchase.
4. Making the agreement
The agreement is binding on both parties once the buyer has sent their order to the seller. However, the agreement is not binding if there was a writing or typing error in the seller's offer that the buyer understood or should have understood.
5. Payment
Payment is made through Kustom, which offers card, Vipps, invoice and instalments. The amount is reserved when you place your order and charged when the goods are sent. If you pay by invoice or in instalments, the payment provider's terms apply.
6. Delivery
Delivery has taken place when the buyer, or their representative, has taken over the goods. If the time of delivery is not stated in the ordering process, the seller must deliver the goods to the buyer without undue delay and no later than 30 days after the order.
7. Risk for the goods
The risk for the goods passes to the buyer when they, or their representative, have received the goods in accordance with section 6.
8. Right of withdrawal
The buyer has a 14-day right of withdrawal from the day after the goods are received. The buyer must tell the seller that they are using the right of withdrawal before the deadline, for example by using the withdrawal form or sending an email to post@chilichocolate.no. The buyer pays the direct costs of returning the goods, unless otherwise agreed. The seller must refund the purchase price without undue delay, and no later than 14 days after the seller was told of the buyer's decision to use the right of withdrawal.
9. Delay and failure to deliver
If the seller does not deliver the goods, or delivers them late, and this is not the buyer's fault, the buyer may withhold the purchase price, demand delivery, cancel the agreement and/or claim compensation from the seller.
10. Faults in the goods – complaints
If there is a fault in the goods, the buyer must tell the seller, within a reasonable time after discovering it, that he or she wants to claim for the fault. The deadline for making a complaint is two years, or five years for goods that are meant to last considerably longer.
11. Personal data
How we process personal data is described in our privacy policy.
12. Resolving disputes
Complaints should be sent to the seller within a reasonable time. The parties will try to settle any disputes amicably. If this does not succeed, the buyer can contact Forbrukertilsynet (the Norwegian Consumer Authority) for mediation. The buyer can also use the European Commission's complaints portal.
